1. Definitions
In these Terms and Conditions:
- "petalresa," "we," "us," "our" refers to petalresa senior residential care facility located at 91/7 Moo 2, Pak Chong, Nakhon Ratchasima 30130, Thailand
- "Resident" refers to the senior individual receiving care services
- "Family" or "Representative" refers to the legal representative, designated family member, or authorized contact person
- "Services" refers to the residential care, activities, meals, and accommodation provided by petalresa
- "Agreement" refers to the written residential care agreement signed upon move-in
2. Acceptance of Terms
By engaging our services, visiting our facility, or using our website, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services or website.
These terms apply to all residents, families, representatives, and visitors. For residential care services, a separate written agreement will be signed that incorporates these terms and includes specific details about care arrangements and fees.
3. Eligibility and Admission
petalresa provides residential care for seniors who:
- Are 60 years of age or older
- Require assistance with daily living activities but not complex medical care
- Can benefit from a homelike environment with cultural activities
- Are able to participate safely in our single-story facility setting
We conduct an assessment before admission to determine if our services match the individual's needs. We reserve the right to decline admission if we cannot appropriately serve the applicant's care requirements.
4. Services Provided
petalresa offers the following residential care services:
Country Residential Living includes:
- Private room with ceiling fan and air conditioning
- Three daily meals featuring Thai cuisine
- Housekeeping and laundry services
- Daily personal care assistance (morning and evening routines)
- Garden and heritage activities program
- 24-hour staff presence
Services NOT provided:
- Medical care, nursing services, or complex health management
- Medication administration (residents manage their own or families arrange external support)
- Transportation to medical appointments
- Specialized dementia or memory care
- Physical therapy or rehabilitation services
5. Fees and Payment
Monthly fees for services:
- Homelike Daily Care: ฿5,100 per month
- Garden & Heritage Activities: ฿14,500 per month
- Country Residential Living: ฿39,500 per month
Payment Terms:
- Monthly fees due on the first day of each month
- Payment accepted via bank transfer or cash
- Late payments subject to ฿500 administrative fee after 10 days
- Initial deposit of one month's fee required upon move-in
Additional Costs:
- Personal items (toiletries, clothing, personal supplies)
- Special dietary requests beyond regular menu
- External medical services or medications
- Personal transportation arrangements
We notify families in writing at least 30 days before any fee changes.
6. Cancellation and Termination
By Family/Resident:
Either party may terminate the agreement with 30 days written notice. The resident or family receives a refund of any prepaid fees for unused days, minus a ฿2,000 administrative fee. The initial deposit is refundable upon departure after deducting any outstanding balances.
By petalresa:
We may terminate the agreement with 30 days notice if:
- The resident's care needs exceed our capabilities
- Payment obligations are not met after two months
- Behavior poses safety concerns for other residents or staff
- The family repeatedly violates facility policies
Immediate Termination:
We reserve the right to immediate termination without notice if a resident's behavior poses immediate danger to themselves, other residents, or staff. In such cases, we assist the family in finding appropriate alternative care.
7. Resident Rights and Responsibilities
Rights:
- Privacy and dignity in all care interactions
- Choice in daily routines, meals, and activity participation
- Freedom to receive visitors during daily hours (8:00 AM - 6:00 PM)
- Access to personal belongings and room personalization
- Respectful treatment from all staff members
- Clear communication about care and any changes
Responsibilities:
- Treat staff and other residents with respect
- Follow facility safety guidelines
- Inform staff of health changes or concerns
- Respect other residents' privacy and belongings
- Participate cooperatively in care routines
8. Family Responsibilities
- Provide accurate information about the resident's needs and preferences
- Update emergency contact information promptly
- Arrange external medical care when needed
- Pay fees on time according to the agreement
- Inform petalresa of any significant health changes
- Respect facility policies during visits
- Participate in care planning discussions when requested
9. Liability and Disclaimer
petalresa provides residential care services with reasonable care and attention. However:
- We are not liable for medical conditions or health changes that occur naturally with aging
- We are not responsible for loss or damage to personal belongings (families should consider personal property insurance)
- We are not liable for outcomes of external medical care arranged by families
- Our liability is limited to direct damages up to one month's fees
- We are not liable for injuries resulting from a resident's own actions against staff advice
This limitation does not affect liability for death or personal injury resulting from our negligence, or any liability that cannot be excluded under Thai law.
10. Personal Belongings
Residents may bring personal items to make their rooms feel like home. However:
- We recommend against bringing highly valuable items
- petalresa is not responsible for loss, theft, or damage to personal property
- Families should label personal items with the resident's name
- We reserve the right to ask families to remove items that pose safety concerns
- Upon departure, families must collect all personal belongings within 14 days
11. Visiting Policy
Families are welcome to visit anytime during our daily hours from 8:00 AM to 6:00 PM without appointment. For visits outside these hours or overnight stays, please contact us in advance. We ask that visitors:
- Check in at the front desk upon arrival
- Respect other residents' privacy
- Follow staff guidance regarding meal times and activity schedules
- Postpone visits if experiencing contagious illness
12. Privacy and Data Protection
Personal information collected and used by petalresa is handled according to our Privacy Policy and Thailand's Personal Data Protection Act (PDPA). We maintain confidentiality of resident information and share details only with authorized family contacts and as required by law.
13. Amendments to Terms
We may update these Terms and Conditions to reflect changes in our services or legal requirements. When we make significant changes, we notify residents and families in writing at least 30 days before the changes take effect. Continued use of our services after changes indicates acceptance of the updated terms.
14. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of Thailand. Any disputes arising from these terms or our services will be resolved in the courts of Nakhon Ratchasima Province, Thailand.
Before pursuing legal action, we encourage families to discuss concerns directly with petalresa management to seek resolution through good-faith dialogue.
